How are cryptocurrencies taxed in Kenya?

Cryptocurrencies in Kenya are taxed at the rate of 3%. The tax is charged on the entire amount being exchanged or transffered. It is not based on gains.

Who collects digital assets tax?

This tax is collected and remitted to Kenya Revenue Authority by exchanges, dexes, the platform owner or any othe person facilitating the transfer.

In addition, the platform owner or facilitator must file a return detailing the amount of payment, tax deducted and any other details required by KRA. A non-resident owner of a digital platform where digital assets are transferred or exchanged must register under the simplified tax regime.

When is digital assets tax paid?

The tax must be remitted to the KRA within five working days after the withholding. This implies that exchanges will need to file returns and pay taxes on a daily basis.

The effective date is 1 September 2023
